These Terms of Service ("Terms") form a binding agreement between you and CollarIQ, Inc. ("CollarIQ", "we"). By purchasing, downloading, or using any CollarIQ product, app, or service, you accept these Terms. If you don't agree, please don't use the Services.
1. The Service
CollarIQ provides: (a) a smart collar device with GPS, cellular, and biometric sensors; (b) a connected iOS, Android, and web app; and (c) a subscription that enables live cellular tracking, AI behavior and health insights, lost-dog recovery, and cloud history.
2. Eligibility & Accounts
You must be at least 18 years old and able to enter into a binding contract. You're responsible for keeping your password secure and for all activity under your account. Notify us immediately at security@collariq.pet if you suspect unauthorized access.
3. Subscription & Billing
- Subscriptions are billed monthly or annually in advance and auto-renew until canceled.
- You can cancel anytime in Settings → Subscription. Access continues through the end of the paid period; we do not pro-rate unused time.
- Prices are shown in your local currency where supported, exclusive of taxes. Taxes are added at checkout where required.
- If a charge fails, we may retry up to 5 times over 14 days before suspending cellular features.
- Cellular features require an active subscription and depend on carrier coverage.
4. 30-Day Trial & Refunds
New hardware purchases include a 30-day risk-free trial. See our Shipping & Returns page for the full process. Subscription fees are non-refundable except where required by law.
5. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the CollarIQ apps and software for your own pet care. You may not copy, modify, reverse engineer, decompile, or create derivative works of the firmware or software, except where such restriction is prohibited by law.
6. Acceptable Use
You agree not to:
- Use the Services to track people or animals you do not lawfully own or care for.
- Interfere with, probe, or attempt to gain unauthorized access to our systems.
- Resell or commercially exploit the Services without our written permission.
- Use the Services for any unlawful purpose.
7. Not a Medical Device
CollarIQ surfaces wellness insights and trends but is not a veterinary medical device and is not intended to diagnose, treat, cure, or prevent disease. Always consult a licensed veterinarian for medical decisions, and call your vet immediately in an emergency.
8. Hardware Warranty
New CollarIQ hardware is covered by a 1-year limited warranty against defects in materials and workmanship under normal use. Optional CollarIQ Care extends coverage to 2 years and includes one accidental damage replacement. Warranty does not cover loss, theft, chew damage, or modifications. 9. User Content
You retain ownership of photos, dog names, notes, and other content you upload. You grant CollarIQ a worldwide, royalty-free license to host, display, and process that content solely to operate and improve the Services. You're responsible for ensuring you have the rights to any content you upload.
10. Intellectual Property
CollarIQ, the CollarIQ logo, and all related marks are trademarks of CollarIQ, Inc. All software, firmware, designs, and content provided by us are protected by copyright and other intellectual-property laws.
11. Third-Party Services
Some features integrate third-party services (maps, payments, carriers). Your use of those services is governed by their own terms.
12. Disclaimers
The Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that location data will always be accurate.
13. Limitation of Liability
To the maximum extent permitted by law, CollarIQ's total liability arising out of or relating to the Services will not exceed the greater of (a) the amount you paid for the product in the 12 months preceding the claim, or (b) US $100. We will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits or loss of pet companionship.
14. Indemnification
You agree to defend and indemnify CollarIQ against any third-party claims arising from your misuse of the Services or breach of these Terms.
15. Termination
We may suspend or terminate your access if you violate these Terms. You may stop using the Services at any time. Sections that by their nature should survive termination will survive.
16. Dispute Resolution & Arbitration
Most concerns can be resolved by contacting support@collariq.pet. Any dispute that can't be resolved will be settled by binding individual arbitration under the AAA Consumer Arbitration Rules, in San Francisco, California — except you may bring claims in small-claims court if eligible. You and CollarIQ waive the right to a jury trial and to participate in a class action. EU consumers retain rights under their local laws.
17. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules.
18. Changes
We may update these Terms. We'll notify you of material changes at least 30 days in advance. Continued use after the effective date means you accept the updated Terms.
